TUPE

TUPE (Transfer of Undertakings (Protection of Employment) Regulations) protects employees’ rights when their employment transfers to a new employer, such as when NHS services are outsourced, privatized, or reorganized.


Under TUPE:

Employees automatically transfer to the new employer with their existing terms and conditions.

Continuity of employment is preserved.

The new employer must consult with staff about changes.

Changes to contracts are restricted unless there’s an Economic, Technical, or Organizational (ETO) reason.

Pension rights under NHS schemes don’t transfer automatically but alternative arrangements may apply.
