TUPE (Transfer of Undertakings (Protection of Employment) Regulations) protects employees’ rights when their employment transfers to a new employer, such as when NHS services are outsourced, privatized, or reorganized.
Under TUPE:
• Employees automatically transfer to the new employer with their existing terms and conditions.
• Continuity of employment is preserved.
• The new employer must consult with staff about changes.
• Changes to contracts are restricted unless there’s an Economic, Technical, or Organizational (ETO) reason.
• Pension rights under NHS schemes don’t transfer automatically but alternative arrangements may apply.
